The document published on this page contains the terms of service (hereinafter also referred to as "TOS") of the website www.masticationpedia.org (hereinafter also referred to as "Site") and the services provided through it, in the version approved by the The Charity, owner of the Site, with the latest update of November 21, 2019.

We recommend that you read this document carefully before using the Site and the services provided through it. The TOS are in fact general conditions and are legally binding between you (also referred to as the "User") and the Charity (also referred to as the "Masticationpedia"), concerning the access and use of the Site and the services provided via this medium.

Nature and acceptance of TOS

• This set of terms and conditions (in addition to the Privacy Policy which can be accessed through the appropriate link at the bottom of each page of the Site) is unconditionally and irrevocably accepted in its entirety when the User, after the first access, continues to use the Site.

Beware: in case you do not want to accept, in whole or in part, these TOS, you are requested to leave the Site now and/or, in any case, to stop browsing through it. We are not interested in providing any content where these conditions are not accepted and where the terms of this page are not accepted.

Changes to TOS

1. These TOS may undergo additions or variations in order to make them adequate with respect to any technical and/or operational changes made to the Site and services. Masticationpedia will inform Users with specific notices of any changes. However, it is advisable to periodically check this page to stay updated on the latest version of the TOS.
2. Any updated versions, which will bear the date on which the update was carried out, will be published promptly on this web page and will become effective immediately after their publication.
3. Reserved access area and newsletter

1. Some contents and services accessible through the Site are intended for specific categories of registered Users, by accessing a Reserved Area and enabling them to use certain services. Access to the Reserved Area takes place through credentials chosen by the User when registering on the Site. The access credentials are strictly personal and not transferable.
2. It is the specific responsibility of the User to use every suitable measure to guarantee the confidentiality of their access credentials. The User is directly responsible for any activity carried out using his own account and/or his login credentials.
3. Masticationpedia cannot be held liable in any way for any damage of any nature suffered by the User as a consequence of the unauthorized or however abusive use of the account or of the User's login credentials put in place by third parties. On the contrary, the User will be responsible for any and all damage suffered by Masticationpedia as a result of the use of his account or his login credentials put in place by third parties.
4. The User can sign up for the Website's newsletter service, which can also be managed externally (outside the masticationpedia.org domain) directly and/or through other platforms.

Use of the "social" functions of the Site

1. The Site allows all Users to be able to use "social" functions by exploiting the connection with third-party services. 3. The User is aware that the shares can be used and re-shared by Masticationpedia and/or other Users both within the Site and on the social networks connected to the Site.

Restrictions on use of the Site, licenses and intellectual property

1. The User is aware that, even beyond the penal provisions for computer crimes, he undertakes not to carry out reverse engineering, de-compilation, de-assembly, modification or creation of derivative works based entirely or partially on the Site and/or on the internal search engine; all intellectual property rights relating to the Site and services, except for the content produced for distribution, in fact belong exclusively to Masticationpedia. This does not impair the User's ability to use the individual contents released with free license in the way he/she prefers as long as his/her use is coherent with the license with which Masticationpedia makes them available.
2. All the contents that the User gives to the Site, including the comments on the discussion pages, are intended to be validly and effectively released in the public domain, or with a "CopyZero" license, or with a "CC BY-SA" license (Creative Commons Attribution license -Attribution, Share Alike); it is the sole responsibility of those who confer to make sure that they have full and incontestable rights to the content and/or material they send us for distribution. Masticationpedia does not accept contributions with any other kind of license. The interface with which the User is allowed to send contributions to the Site contains the detailed conditions by which the User sends and the Site receives these contributions.
3. All names, signs or other symbols on the Site may be registered trademarks by their respective owners. Unauthorized use of these signs may constitute a violation of the rights of their respective owners, and as such, can be prosecuted judicially.
4. The Masticationpedia logo belongs to the Charity and is not transferable and non-usable without prior and specific written authorization to be granted on a case by case basis.

Privacy

The purposes and methods of processing the User's personal data connected with accessing and using the Site are indicated in the Privacy Policy which can be accessed through the link at the bottom of each page of the Site, an to which we entirely make reference.

Interpretation

• The technical/IT terms contained in these TOS must be interpreted in the common sense and in the current meaning that they have in the IT context of reference.

Safety and security

Although the services offered by Masticationpedia normally are not a vehicle for viruses, worms, trojans or other malware, it is not possible to exclude a priori that any malicious code may be conveyed, by browsing the Site, on the User's computer. It is therefore the sole responsibility of the User to provide him/herself adequate tools for a safe navigation (by way of example and not limited to: constantly updated antivirus and firewall, etc.).

Disclaimer

1. Masticationpedia disclaims any liability, to the fullest extent permitted by law and with the sole exclusion of hypotheses attributable to willful misconduct or gross negligence of the same, for any and all damage, direct or indirect, that the User might suffer as a result of or in relation to the access to or use of the Site or related services.
2. Masticationpedia is in no way responsible for any loss of data, for the dissemination of personal or sensitive data and for any other type of damage directly or indirectly suffered by the User that has been caused by malware present on the Internet.

User responsibility

1. The User undertakes to use the Site and the services in accordance with the provisions of these TOS and, in any case, exclusively for lawful purposes.
2. Any violation of these TOS by the User implies the immediate cessation of the consent of Masticationpedia to entertain an interaction with the User and exposes the User to all the responsibilities provided for by law.

Acquiescence

• The missed or delayed exercise by Masticationpedia of the rights, faculties or options provided for in these TOS does not constitute acquiescence or renunciation of the same.

Applicable law and jurisdiction

1. The interpretation and execution of these TOS, as well as the relations between Masticationpedia and the User deriving from the same, are governed by British law, with the express exclusion of the application of the rules of private international law of that legal system.
2. Except in cases where jurisdiction is mandatorily established by law, all disputes arising from, or in any case relating to these TOS, will be subject to the exclusive jurisdiction of the London (UK) Courts, with the express waiver of the User for any exception with respect to to that Court.
